Abba Kyari remains in detention as court refuses bail application

Suspended Deputy Commissioner of Police (DCP), Abba Kyari, will remain in detention in the custody of the National Drug Law Enforcement Agency (NDLEA), notwithstanding his plea for bail.

The embattled former commander of the Intelligence Response Team of the Nigeria Police had filed an ex-parte motion at a Federal High Court, Abuja, through his lawyer, C.O. Ikenna, claiming he was suffering from diabetes and hypertension.

However, Justice Inyang Ekwo, who is presiding over the matter, declined to grant the plea but ordered that the NDLEA be put on notice.

“My lord, his (Kyari’s) condition at the custody is critical. I filed a motion to admit the applicant to a bail on health grounds, pending the determination of the substantive matter,” the lawyer told the judge.

The judge then asked what the substantive matter was all about and the responded: “The substantive matter is about infringement on his fundamental rights and false allegations.”

Justice Ekwo then asked: “Where is the applicant?”

“He is at the NDLEA’s custody, my lord,” she replied.

RELIABLESOURCENG.COM reports that Kyari was arrested and handed over to the NDLEA by the Police in connection with a 25kg of Cocaine, seized from a drug cartel.

Ekwo told the lawyer that going by the averment in the application, the respondent, NDLEA, would have to be put on notice and a date fixed to hear the motion.

He said this was so because the averment Ikenna made would need NDLEA’s response. The judge, thereafter, adjourned the matter until April 24 for the motion to be taken.
